These Terms & Conditions ("Terms") govern your use of this website and your booking of charter and underwater services with AQQQUAMAN Under Water Works & Charters ("AQQQUAMAN," "we," "us"). By using this site, submitting a booking or service request, or boarding the vessel, you agree to these Terms.
1.Services
AQQQUAMAN provides (a) private passenger charters aboard Ship Of Fools, a 53-foot Sea Ray operated by a USCG-credentialed captain, and (b) professional underwater services including item recovery, hull inspection, propeller and anchor retrieval, dock maintenance, and underwater surveys. All services are subject to availability, weather, and safe operating conditions.
2.Bookings, Deposits & Payment
A booking request submitted through this site is not confirmed until we confirm availability and receive your deposit. A 50% deposit is required to secure your charter date; the remaining balance is due on the day of the charter before departure. Accepted payment methods are communicated at confirmation. Underwater services are quoted individually and payable as stated in the quote.
3.Cancellations & Refunds
- Cancellations made 72 hours or more before departure receive a full deposit refund.
- Cancellations within 72 hours of departure forfeit the deposit.
- Same-day cancellations or no-shows owe the full charter fee.
- If the captain cancels for weather, sea state, or unsafe conditions, you may choose a full refund or a reschedule at no additional charge.
- If we cancel for mechanical failure or other operator-side reasons, all amounts paid are refunded in full.
4.USCG Compliance & Safety
The vessel operates under a USCG-credentialed captain and carries all USCG-required safety equipment. A mandatory safety briefing is given before every departure and all passengers must attend. Children under 13 must wear a USCG-approved life jacket at all times; non-swimmers are strongly encouraged to do the same. Maximum capacity is 12 passengers. Passengers must remain in designated areas while underway and may not sit or stand on the gunwales, bow, or transom while the vessel is moving. Swimming is permitted only when anchored and with the captain's explicit permission.
5.Captain's Authority
The captain holds sole and final authority over the vessel and everyone aboard. The captain may alter the route, itinerary, or duration, or cancel or end the charter at any time due to weather, sea state, mechanical issues, or safety concerns. Such decisions do not constitute a breach of these Terms.
6.Conduct, Alcohol & Prohibited Items
Alcohol is permitted for adults of legal drinking age only. The captain may end the charter and return to port, without refund, if any passenger's behavior or intoxication jeopardizes safety. Illegal substances are strictly prohibited and result in immediate termination of the charter without refund. Passengers must follow all instructions from the captain and crew. The charterer is responsible for the conduct of all invited guests and for any damage to the vessel beyond normal wear and tear.
7.Assumption of Risk; Waiver & Charter Agreement
Boating and water activities involve inherent risks, including personal injury, illness, death, and loss of property, which the charterer and all passengers voluntarily assume. A separate Private Charter Agreement and Liability Waiver & Release must be signed before departure and govern the charter together with these Terms. In the event of a conflict, the signed agreement controls.
8.Limitation of Liability
To the maximum extent permitted by law, including the Limitation of Liability Act (46 U.S.C. §§ 30501–30512), AQQQUAMAN's total liability arising out of or relating to any charter or service will not exceed the total fee paid for that charter or service, and AQQQUAMAN will not be liable for consequential, incidental, special, or punitive damages.
9.Indemnification
The charterer agrees to indemnify and hold harmless AQQQUAMAN, its owner, captain, and crew from claims, damages, and expenses arising from the acts or omissions of the charterer or their guests, violations of vessel rules, or damage to property.
10.Personal Property & Insurance
AQQQUAMAN carries marine liability insurance. This coverage does not extend to passengers' personal property or valuables; guests are encouraged to carry personal travel or accident insurance. Discharging trash or any substance overboard is prohibited and may be reported to the USCG or EPA.
11.Underwater & Diving Services
Underwater services are performed by certified divers on a best-effort basis. Recovery of lost items is not guaranteed; fees quoted cover the dive effort, not a guaranteed result, unless expressly stated otherwise in writing. You represent that you own, or are authorized to grant access to, any dock, vessel, or property where services are performed, and that any item requested for recovery is lawfully yours to recover. We may decline any job that is unsafe or unlawful.
12.Website Use & Intellectual Property
This website and its content (text, images, video, logos, branding) are the property of AQQQUAMAN and may not be reproduced without permission. The site is provided "as is" without warranties of any kind. We may update site content, pricing, and availability at any time.
13.Governing Law & Disputes
These Terms are governed by U.S. general maritime law and, where applicable, the laws of the state in which the vessel primarily operates. The parties will first attempt to resolve any dispute through good-faith mediation; failing that, disputes will be resolved by binding arbitration or by a court of competent maritime jurisdiction, at the operator's election.
14.Changes to These Terms
We may update these Terms from time to time. The effective date above reflects the latest revision. Continued use of the site or services after changes constitutes acceptance of the updated Terms.
